I was involved in a real estate transaction where Metropolitan Escrow & Title served as the escrow agent. After the deal was terminated, we submitted a formal demand to have the earnest money returned, as allowed under Paragraph 18(C) of the TREC contract. There was no written objection from the seller or listing agent within the required 15-day period. Yet on the 20th day, the title company finally responded, refusing to release the funds and stating: “The contract has no forwarding information for the seller...” and that they were unable to comply with the provision. We found it odd that a title company wouldn’t have the seller’s contact information. Regardless, we located the seller’s email address ourselves from the executed contract (via eSignature) provided by the listing agent, and sent a second demand letter including the seller’s information. After that, Metropolitan Title stopped responding altogether. We followed up multiple times over several months with no reply. Eventually, we filed a complaint with the Texas Department of Insurance, which investigated and issued a warning because the company failed to respond even to the regulator. It has now been nearly 16 months since we opened title, and the earnest money still hasn’t been returned. Their complete lack of communication and refusal to follow basic contract terms or even respond to a state agency is completely unacceptable.
