FairlyInsured, LLC ("FairlyInsured," "we," "us," or "our") operates fairlyinsured.com and related tools and subdomains (the "Site"). Access to the Site is provided at no charge.
These Terms of Use ("Terms") govern your access to and use of the Site and all associated services, features, and content made available through it (collectively, the "Services"). We may revise these Terms periodically. Continued use of the Services following any update constitutes acceptance of the revised Terms. If you do not agree to these Terms in their entirety, please discontinue use of the Services immediately.
Where the Services contain links to external websites, your use of those sites is governed by their respective terms — not these Terms.
We work to keep information on the Services accurate — including advisor license data, carrier affiliations, coverage types, service areas, and contact details — but cannot guarantee that all information is current or error-free. Profile data may be sourced from public records or third-party databases that are not updated in real time. You are responsible for independently confirming any information you rely on through the Services before acting on it.
1. About FairlyInsured
FairlyInsured is a Texas-based independent insurance advisor directory and referral platform. We help consumers find and connect with licensed, independent insurance advisors. We are not an insurer, agent, or broker. We do not quote, sell, underwrite, or bind insurance coverage of any kind. Nothing on the Services constitutes insurance advice, a coverage recommendation, or any representation about the suitability of a particular advisor or product for your needs.
2. Your Privacy
How we collect, use, and protect your information is described in our Privacy Policy at fairlyinsured.com/privacy, which is incorporated into these Terms by reference. Please review it before using the Services.
3. Accounts and Registration
Certain features of the Services require you to create an account. When registering, you agree to provide truthful, current, and complete information and to keep it up to date. Accounts with materially inaccurate or outdated information may be suspended.
You are solely responsible for maintaining the security of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, contact us at support@fairlyinsured.com right away. FairlyInsured is not liable for losses resulting from your failure to protect your account credentials.
4. Permitted Use
The Services may be used by consumers for personal, non-commercial purposes — such as browsing advisor profiles, submitting coverage inquiries, or using the AI Concierge or Coverage Checkup tools. Advisors may use the Services to manage their listings and respond to leads through their subscription tier.
You may not reproduce, distribute, republish, resell, or create derivative works from any part of the Services without our prior written consent.
5. Consumer Terms
5.1 Informational Purpose Only
All content on the Services — including AI-generated recommendations, Coverage Checkup summaries, and advisor profiles — is for general informational and referral purposes only. It is not a substitute for advice from a licensed insurance professional who understands your specific situation.
5.2 Your Relationship with Advisors
FairlyInsured facilitates introductions between consumers and advisors. Any coverage decisions, policy applications, quotes, or purchases that follow are exclusively between you and the advisor you engage. FairlyInsured has no role in those transactions and assumes no responsibility for an advisor's conduct, recommendations, or errors.
5.3 Submitting an Inquiry
When you submit a request through the Services — via the AI Concierge, Coverage Checkup, or an advisor's profile page — you consent to being contacted by advisors in connection with your request. You confirm that the information you submit is accurate. We do not guarantee that any advisor will respond to your inquiry.
5.4 No Vetting or Endorsement
Presence in the FairlyInsured directory does not mean an advisor has been vetted, endorsed, or certified by FairlyInsured. We encourage you to verify advisor credentials directly with the Texas Department of Insurance at tdi.texas.gov before engaging any advisor.
6. Advisor Terms
6.1 Profile Accuracy
Advisors are responsible for the accuracy of their profiles, including license status, carrier relationships, coverage lines, service areas, languages, and contact information. FairlyInsured may pre-populate profiles using TDI public records or third-party data enrichment. Advisors must review their profiles and correct any errors or outdated information.
6.2 Licensing Requirements
By participating as an Advisor, you represent that you hold all Texas Department of Insurance licenses required for the lines of authority listed on your profile, and that those licenses are active and in good standing. You must notify FairlyInsured promptly if any license is allowed to lapse, is placed on probation, or is revoked. We may deactivate profiles linked to non-compliant licenses at any time.
6.3 Subscription Tiers
Advisor access to platform features is determined by your active Subscription Tier: Free, Pro, Premier, or Elite. Lead routing, directory placement, portal access, analytics, and AI Insights are each gated by tier. Feature availability is described on the pricing page and may be updated with reasonable advance notice.
6.4 Leads
Leads are delivered to advisors as a paid-tier feature. FairlyInsured makes no representations about Lead volume, quality, or conversion likelihood. Advisors must handle all consumer contact in compliance with applicable federal and Texas law, including the TCPA, CAN-SPAM Act, and Texas Insurance Code. Lead contact information may not be shared with, sold to, or used on behalf of any third party.
6.5 Restricted Conduct
Advisors may not misrepresent their licensing, carrier access, or independence; use platform Leads to promote services outside the scope of a consumer's original inquiry; manipulate directory rankings or scoring systems; impersonate another advisor or agency; or represent themselves as independent while exclusively writing for a single carrier.
6.6 Advisor Portal
Paid-tier advisors may edit certain profile fields through the advisor portal, including their bio, contact details, and photo. Fields governing service areas, carrier appointments, coverage lines, specialty designations, subscription tier, and lead routing eligibility are managed by FairlyInsured and are not editable through the portal. Attempts to circumvent these restrictions will result in account review and may result in suspension.
6.7 Billing
Subscriptions renew automatically at the rate for your selected tier. You may cancel at any time; your access continues through the end of the paid billing period. Partial-period refunds are not issued except as required by law. We will provide at least 30 days' notice before implementing pricing changes.
7. API Access
API access is available to authorized partners only and requires a separate written agreement with FairlyInsured. Permitted uses are limited to those expressly defined in that agreement. You may not use the API to build competing platforms, aggregate advisor or consumer data beyond your authorized scope, bypass authentication or rate limiting, or extend access to unauthorized third parties. FairlyInsured may modify or discontinue API availability with reasonable notice.
8. AI-Generated Content
FairlyInsured uses AI tools — including the Anthropic Claude API — to generate advisor descriptions, lead playbooks, Concierge responses, and Coverage Checkup summaries. This content is produced algorithmically and may be incomplete, imprecise, or not suited to your specific circumstances. It does not constitute insurance, legal, or financial advice. Neither consumers nor advisors should make coverage or business decisions based solely on AI-generated content.
9. Texas Department of Insurance Data
Some advisor data on the Services is drawn from TDI public records, including license numbers, appointed lines, and agency addresses. This information is provided for reference only and is not guaranteed to reflect current TDI records. FairlyInsured is not affiliated with or endorsed by the Texas Department of Insurance. To confirm a license, visit tdi.texas.gov.
10. User-Submitted Content
Some areas of the Services allow users to submit ratings, reviews, or other content ("User Content"). By submitting User Content, you represent that you have the right to do so and that it is accurate to the best of your knowledge. You grant FairlyInsured a non-exclusive, royalty-free, perpetual, worldwide license to use, display, adapt, and distribute your User Content in connection with operating and promoting the Services. We are not obligated to publish or retain any User Content and may remove it at any time at our discretion.
11. Acceptable Use
You agree to use the Services honestly and in a manner consistent with applicable law. The following are prohibited:
- Submitting false or misleading information about yourself, your agency, or your insurance needs.
- Harvesting contact information or other data from the Services for unauthorized commercial purposes.
- Using automated tools — including scrapers, crawlers, or bots — to access or extract data from the Services without written authorization.
- Impersonating any person, agency, or entity.
- Uploading or transmitting malicious code, spam, or content designed to disrupt the Services.
- Attempting to access accounts, systems, or data that you are not authorized to access.
Violations may result in immediate suspension or termination of your access without notice.
12. Intellectual Property
All content on the Services — including directory data, enriched profile content, Learning Center articles, design elements, and AI outputs — is owned by or licensed to FairlyInsured. Nothing in these Terms grants you ownership of or license to any FairlyInsured intellectual property beyond what is expressly stated. Unauthorized reproduction or distribution of platform content may violate copyright and other applicable law.
13. Text and SMS Communications
FairlyInsured may send text messages to consumers and advisors for purposes including lead notifications, account alerts, and platform updates. By providing a mobile number and opting in, you consent to receive these messages. Standard carrier message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Message frequency varies. FairlyInsured is not responsible for delays caused by wireless carriers or network conditions.
14. Third-Party Integrations
The Services connect with or link to third-party tools and platforms. FairlyInsured does not control those services and is not responsible for their content, performance, or data practices. Your use of any third-party service is governed by that service's own terms.
15. Disclaimer of Warranties
The Services are made available on an as-is and as-available basis. FairlyInsured does not warrant that the Services will be continuous, accurate, secure, or free from errors or interruptions. To the fullest extent allowed by law, FairlyInsured disclaims all warranties — express, implied, or statutory — including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This disclaimer applies to all content on the Services, including advisor profile data, AI-generated content, and third-party information.
16. Limitation of Liability
To the maximum extent permitted by applicable law, FairlyInsured will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or reputational harm — arising from your use of or inability to access the Services. In no event will FairlyInsured's aggregate liability to you exceed the greater of the total fees you paid to FairlyInsured in the twelve months preceding your claim or one hundred dollars ($100).
17. Indemnification
You agree to defend, indemnify, and hold FairlyInsured and its officers, directors, employees, and agents harmless from any claims, damages, liabilities, and legal costs (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, your violation of any applicable law, or any User Content you submit.
18. Suspension and Termination
FairlyInsured may suspend or terminate your access to the Services at any time, for any reason, with or without prior notice. Termination does not entitle you to a refund of any prepaid fees except as required by applicable law. Sections of these Terms that are intended to survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will remain in effect.
19. Modifications to the Services and Terms
We may update, modify, or discontinue any aspect of the Services at any time. We may also revise these Terms at any time by posting an updated version to the Site. Material changes will be flagged by updating the date at the top of this page and, where appropriate, by email notice to registered Advisors. Your continued use of the Services after changes take effect constitutes acceptance.
20. Governing Law and Disputes
These Terms are governed by Texas law, without giving effect to any conflict of law principles. Any legal dispute arising out of or related to these Terms or the Services will be brought exclusively in state or federal courts in Travis County, Texas. You consent to the jurisdiction of those courts. Notwithstanding the foregoing, FairlyInsured reserves the right to seek emergency injunctive relief in any jurisdiction to protect its intellectual property or proprietary rights.
21. General Provisions
These Terms represent the complete agreement between you and FairlyInsured with respect to the Services and supersede all prior understandings or representations on the same subject. If any provision is held unenforceable, the remaining provisions continue in full force. No waiver of any Term by FairlyInsured constitutes a continuing waiver or waiver of any other Term.
