We worked with the title company, not by choice but because this was the sellers title company. We were purchasing a home/land and knew from the very beginning we had a 60 day closing due to the process of things that needed to be done on the title. We sent the earnest money, it was “refused” on their end and never made it back to my account. Multiple emails to them from my realtor asking about our earnest money was overlooked and ignored. We sent confirmation numbers and screenshots to multiple people showing it was sent and taken out of our account.. Marley says “it was the banks fault.” Questions weren’t being answered and the office went quiet on us. We finally got ahold of someone, the closing agent, Marley is out and we needed to send an email with our concerns. Well, we FINALLY got a closing date for April 1st and was told we could bring in the earnest money again so we can proceed and not have any delays on closing. We brought in a cashier check and signed documents and we thought we finally closed. NOPE. We received an email that evening from Marley stating the documents we signed that day had missing parcels so funding was on hold and we were told that they would HOLD OUR FUNDS UNTIL EVERYTHING IS RESOLVED. How are you a title company and not over looking the title commitment?? Here’s the catch- Marley left for vacation that night (on a Thursday) and we couldn’t resolve anything until the following Tuesday. So my realtor sent a very professional email stating the documents should’ve been looked over beforehand and how the buyers (my husband and I) were extremely upset about the situation. So I advised her to tell them we would pick the cashiers check up on Friday morning because we didn’t trust them to hold our money (almost $70k) since they lost the earnest money. We went in on Friday morning and the check had already been deposited!! Why are we depositing checks on incorrect contracts?? No one in the office had the ability to write us a check So we went across the road to the sheriff department and he made some to the owner Marley.. one of which we heard Marley talk so much crap about both the seller and buyers realtors and how they were giving us bad advice the whole time. By luck, someone was there that was able to write our check… with the stipulations of: 1 leave the check and we can close the following week, or 2 take the check back and we couldn’t close for a month. I don’t know how holding onto the money would change the timeline and documentation but by the advice of the sheriff, we left the check. Marley comes back into town on Tuesday, we close on Thursday April 9th. Except the paperwork we went to sign on Thursday had wrong information, missing signatures, settlement statement didn’t have my realtors commission on it, wrong closing date. It was just a mess- we refused signing anything until it was ALL correct. Thursday at the table we were told everyone would be funded that evening… except they weren’t. My realtor didn’t get her commission wire for 4 days! Finally received our warranty deed via email after 6 days when we were told it would be sent the day after closing. Oh AND guess what finally showed up a month and a half after being sent in the first time: my earnest money wire, conveniently sent back after we paid for our property. Marley sat here for two months, pointing the blame at everyone else as to why her title company dropped the ball on so many things: she blamed realtors, the seller, the state of Texas, the banks.. never ever took accountability for her failure to process things and over look the documents that you print up for the buyer and seller to sign. I have bought and sold 3 houses with the same realtor… I have never ever experienced anything like this with a title
Company. If you don’t have to work with this company, then don’t. Save yourself the headache and disappointment.
